Traffic Ticket Defense
People often ask: "How do I beat a speeding ticket in New York?" Its difficult for people to handle a traffic ticket themselves because they are not familiar with the rules and procedures of the town courts and local district attorney's office.
If you received a speeding ticket or any other traffic ticket in New York (except NYC), we can handle the ticket for you, which saves you the time and expense of having to travel back to court as many as three (3) times.
Whether you were speeding or not, the courts and the district attorney's office recognize that good people make mistakes and they will consider a reduction of the charges. This is commonly known as a "plea bargain."
Also, you may have a valid defense to the charge. We will present your side of the story to the District Attorney's Office and seek a reduction or dismissal of the charge(s). In almost every case, the points on your license are either reduced or eliminated entirely which will save you money on insurance, DMV assessment fees, fines, and surcharges. In many cases, our clients avoid points on their license all together.
There are also technical reasons for a ticket to be dismissed. We review the documents to make sure that the tickets are legally sufficient. If the ticket is not sufficent, we file a motion to have the case dismissed.
Avoid Suspension or Revocation of Your License
Please be advised, that if you fail to appear in court as directed, or fail to properly dispose of a ticket, you can be charged additional fees, lose your privilege to operate a motor vehicle, and may even end up with a warrant for your arrest. We will make sure the case is properly disposed of and that you approve the final outcome of the case.
DMV Driver Violation Point System
The DMV uses a point system to identify driver's who have been convicted of traffic infractions. Insurance companies use the system as well to increase your insurance rates. If you have too many points, you will have your license suspended or revoked. You can contact us to see if you are in danger of having your license suspended. To view the point system chart you can visit NYS DMV at: http://www.nydmv.state.ny.us/license.htm#points
Driver Responsibility Assessment Fees
In addition to paying the court imposed surcharges and fines on traffic tickets, DMV charges all driver's with six or more points in eighteen months, an assessment fee. This law applies to all drivers, regardless of what state they are licensed in. The minimum charge is $100 per year for three years. We will review your driving record and work on your case to help you avoid the additional assessment fees.
The Cost of Fighting a Traffic Ticket
The cost of fighting a traffic ticket depends on the circumstances. On average, the cost of handling a basic traffic case ranges from $150 to $300. Misdemeanor cases (AUO, Reckless Driving) are between $500 to $1,000. Our goal is to save you more than that amount of money on fines, surcharges, fees, and increased insurance rates.
